{"id":159,"date":"2013-02-12T23:49:45","date_gmt":"2013-02-13T03:49:45","guid":{"rendered":"http:\/\/sites.law.duq.edu\/juris\/?p=159"},"modified":"2013-09-05T00:02:40","modified_gmt":"2013-09-05T04:02:40","slug":"dancing-on-the-grave-of-alex-rodriguezs-career","status":"publish","type":"post","link":"https:\/\/sites.law.duq.edu\/juris\/2013\/02\/12\/dancing-on-the-grave-of-alex-rodriguezs-career\/","title":{"rendered":"Dancing on the Grave of Alex Rodriguez\u2019s Career"},"content":{"rendered":"<figure id=\"attachment_160\" aria-describedby=\"caption-attachment-160\" style=\"width: 250px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2013\/09\/A.Rod_PED.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-160\" alt=\"Photo courtesy of Dennies Ku\/Shutterstock.com\" src=\"http:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2013\/09\/A.Rod_PED.jpg\" width=\"250\" height=\"335\" srcset=\"https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2013\/09\/A.Rod_PED.jpg 250w, https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2013\/09\/A.Rod_PED-223x300.jpg 223w\" sizes=\"auto, (max-width: 250px) 100vw, 250px\" \/><\/a><figcaption id=\"caption-attachment-160\" class=\"wp-caption-text\">Photo courtesy of Dennies Ku\/Shutterstock.com<\/figcaption><\/figure>\n<p style=\"text-align: center;\">by Christopher Bradley, 3L Contributor<\/p>\n<p>A recent <i>Miami New Times <\/i>report implicated several Major League Baseball players in widespread use of Performance Enhancing Drugs (PEDs) provided by the Miami-based anti-aging clinic, Biogenesis.\u00a0 Some of the more recognizable names include Washington Nationals pitcher Gio Gonzalez, Texas Rangers outfielder Nelson Cruz, and proven PED users, Oakland Athletics pitcher Bartolo Colon, Toronto Blue Jays outfielder Melky Cabrera, San Diego Padres catcher Yasmani Grandal, and New York Yankees third baseman Alex Rodriguez.<\/p>\n<div>\n<table cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td><\/td>\n<\/tr>\n<tr>\n<td><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Rodriguez has released a statement vehemently denying these recent allegations; despite his name showing up in the records Biogenesis keeps 16 times.\u00a0 In 2009, Rodriguez openly admitted that he \u201cdabbled\u201d in the use of PEDs between 2001 and 2003 while playing for the Texas Rangers.\u00a0 He cited the immense pressure he was under to perform after signing the 10-year $252 million mega contract, the first of its kind.\u00a0 At the time of this admission, the Yankees took no action against Rodriguez, in 2007, he had signed yet another mega contract, this one being a 10-year $275 million albatross that included millions in incentives for potential record breaking numbers.\u00a0 At the time of this contract it, was universally believed that Rodriguez was a \u201cclean\u201d player and would someday break the all-time homerun record set by proven PED user, Barry Bonds.<\/p><\/div>\n<div><\/div>\n<div>It has been widely reported that the Yankees will attempt to void Rodriguez\u2019s contract, if they are successful, they will not have to pay the remaining $114 million owed to him and will set a precedent that could allow teams to void albatross contracts left and right.\u00a0 This is not the first time the Yankees have attempted to void a contract for a proven PED user.\u00a0 In 2004, when it was revealed that first baseman Jason Giambi used PEDs after he testified in front of a grand jury during the BALCO investigation.\u00a0 The Yankees were unsuccessful in this attempt because Giambi\u2019s contract had specific language preventing such action from being taken.\u00a0 All MLB contracts have moral clauses, preventing teams from voiding contracts based on, among other things, PED use.\u00a0 No team will be successful in voiding a player\u2019s contract unless there is specific language regarding PED use. \u00a0The general consensus is that Rodriguez\u2019s contract contains similar language to Giambi\u2019s deal.<\/div>\n<div><\/div>\n<div>Under Major League Baseball\u2019s collectively bargained Joint Drug Prevention and Treatment Program Section 7, paragraph M states, &#8220;All authority to discipline Players for violations of the Program shall repose with the Commissioner&#8217;s Office. No Club may take any disciplinary or adverse action against a Player (including, but not limited to, a fine, suspension, or any adverse action pursuant to a Uniform Player&#8217;s Contract) because of a Player&#8217;s violation of the Program.&#8221;\u00a0 Furthermore, the Yankees will more than likely be unsuccessful in voiding the contract because after the 2009 admission, and their failure to take action against Rodriguez, it can be said that they legally \u201cratified\u201d his behavior.<\/div>\n<div>It is unclear what will come of Rodriguez\u2019s situation, many reports say that the Yankees front office is exploring other avenues in order to void his contract and effectively end his career. \u00a0One thing is for sure; Major League Baseball\u2019s PED problem is far from over.<\/div>\n<div><\/div>\n<div><i>The Miami New Times report may be found <\/i><a href=\"http:\/\/www.miaminewtimes.com\/2013-01-31\/news\/a-rod-and-doping-a-miami-clinic-supplies-drugs-to-sports-biggest-names\/full\/\"><i>here.<\/i><\/a><i><\/i><\/div>\n<div><i>More commentary may be found <\/i><a href=\"http:\/\/www.grantland.com\/blog\/the-triangle\/post\/_\/id\/49258\/baseballs-ped-problem-wont-seem-to-go-away\"><i>here.<\/i><\/a><i><\/i><\/div>\n<div><\/div>\n<div><\/div>\n<p><i>Christopher is a third-year day division student at Duquesne Law School.\u00a0 He earned his bachelor\u2019s degree at Duquesne, studying political science and history.
