Must the body be removed, and does the decedent\u2019s family have any claim to prevent it?<\/p>\n\n\n\n<p>When a decedent is buried in the wrong plot, both the plot owner and the decedent\u2019s family suffer injuries: the family must accept that their loved one rests in a place not chosen for them, while the plot owner loses her burial place.<sup data-fn=\"9bb04f99-f120-44ae-b153-c0cee0e0ceee\" class=\"fn\"><a href=\"#9bb04f99-f120-44ae-b153-c0cee0e0ceee\" id=\"9bb04f99-f120-44ae-b153-c0cee0e0ceee-link\">1<\/a><\/sup> This pits the family\u2019s interest in repose against the lot owner\u2019s right to the plot and the cemetery\u2019s statutory duty to reinter the body into the correct plot.<\/p>\n\n\n\n<p>The Pennsylvania Supreme Court has long recognized that the law reflects a broader, \u201cuniversal sentiment&#8221; against disturbance of the dead.<sup data-fn=\"e4f095bf-3fd5-414c-9962-68b1308358bf\" class=\"fn\"><a href=\"#e4f095bf-3fd5-414c-9962-68b1308358bf\" id=\"e4f095bf-3fd5-414c-9962-68b1308358bf-link\">2<\/a><\/sup> From 8th century Christian tombstones\u2014which first bore the epitaph, \u2018requiescat in pace,\u2019 or rest in peace<sup data-fn=\"c909da8b-7dfc-4160-9f0f-662fcbbb5998\" class=\"fn\"><a href=\"#c909da8b-7dfc-4160-9f0f-662fcbbb5998\" id=\"c909da8b-7dfc-4160-9f0f-662fcbbb5998-link\">3<\/a><\/sup>\u2014to the hex on Shakespeare\u2019s tombstone at Stratford\u2014\u201ccurst be he that moves my bones\u201d\u2014post-mortem repose is an enduring human value that is reflective of more than just the law.<sup data-fn=\"6590025a-e804-4920-a061-4138d7ef3863\" class=\"fn\"><a href=\"#6590025a-e804-4920-a061-4138d7ef3863\" id=\"6590025a-e804-4920-a061-4138d7ef3863-link\">4<\/a><\/sup><\/p>\n\n\n\n<p>This enduring disdain for disinterment informs Pennsylvania courts\u2019 \u201cgeneral presumption that a decedent would not want his remains disturbed.\u201d<sup data-fn=\"4b9fb593-de06-4b09-99bc-8dde82203a32\" class=\"fn\"><a href=\"#4b9fb593-de06-4b09-99bc-8dde82203a32\" id=\"4b9fb593-de06-4b09-99bc-8dde82203a32-link\">5<\/a><\/sup> To overcome the courts\u2019 aversion to disinterment, a party seeking reinterment must show good cause and be sufficiently related to the decedent to have standing to bring the reinterment suit.<sup data-fn=\"d68768ad-bfc1-4d23-9ca8-b17bdfd1e51a\" class=\"fn\"><a href=\"#d68768ad-bfc1-4d23-9ca8-b17bdfd1e51a\" id=\"d68768ad-bfc1-4d23-9ca8-b17bdfd1e51a-link\">6<\/a><\/sup><\/p>\n\n\n\n<p>When the cemetery is at fault, its statutory duty to rectify the error negates the need for this test. However, when a dispute for disinterment does not trigger a statutory duty\u2014often some form of familial dispute over where the body should lie\u2014courts measure good cause through a multi-factor test that considers the parties\u2019 relationships to the decedent, the decedent\u2019s wishes, the conduct of each party, the time since burial, and the strength of reasons for or against disinterment.<sup data-fn=\"02699708-c9b1-4d2a-a489-e90f986a4327\" class=\"fn\"><a href=\"#02699708-c9b1-4d2a-a489-e90f986a4327\" id=\"02699708-c9b1-4d2a-a489-e90f986a4327-link\">7<\/a><\/sup> Administration and disposition of the decedent is the \u201cparamount\u201d right of the surviving spouse, and Pennsylvania courts are hard-pressed to disregard a widow\u2019s wishes, even against immediate kin, and in some instances, even against the decedent\u2019s own wishes.<sup data-fn=\"05d04884-82eb-47c1-a68e-defa7f6ba6e8\" class=\"fn\"><a href=\"#05d04884-82eb-47c1-a68e-defa7f6ba6e8\" id=\"05d04884-82eb-47c1-a68e-defa7f6ba6e8-link\">8<\/a><\/sup><\/p>\n\n\n\n<p>Applying these rules to the mistaken burial hypothetical, a body mistakenly buried in the wrong plot would trigger the cemetery\u2019s statutory duty to disinter and reinter the body into the correct plot to fix their grave mistake.<sup data-fn=\"ac8265c0-f21d-4492-99f0-7f5a4d17f4ff\" class=\"fn\"><a href=\"#ac8265c0-f21d-4492-99f0-7f5a4d17f4ff\" id=\"ac8265c0-f21d-4492-99f0-7f5a4d17f4ff-link\">9<\/a><\/sup> Since a burial plot is a limited property right, conveying a right to burial but not legal title to the land, which remains with the cemetery,<sup data-fn=\"0777825d-e440-4f08-a7f7-772e5f468304\" class=\"fn\"><a href=\"#0777825d-e440-4f08-a7f7-772e5f468304\" id=\"0777825d-e440-4f08-a7f7-772e5f468304-link\">10<\/a><\/sup> the plot owner could assert her quasi-property right to exclusive burial in that plot.<\/p>\n\n\n\n<p>On the other hand, a decedent\u2019s family might have a claim in protecting repose through a limited property right in their decedent\u2019s interment. While it is widely espoused that there is no property right in a corpse, the Pennsylvania Supreme Court has made it clear that this principle is not absolute.<sup data-fn=\"07df5fc2-cf46-48c9-a048-42f2b49432dc\" class=\"fn\"><a href=\"#07df5fc2-cf46-48c9-a048-42f2b49432dc\" id=\"07df5fc2-cf46-48c9-a048-42f2b49432dc-link\">11<\/a><\/sup><\/p>\n\n\n\n<p>In its seminal reinterment case, the Court recognized a quasi-property right in a corpse arising out of the next of kin\u2019s legal duty to bury the decedent, which affords them a corresponding right of control and disposition of the body\u2014a right of possession in substance if not words.<sup data-fn=\"a81e7596-df7a-4c27-a484-5e09e6ae00ee\" class=\"fn\"><a href=\"#a81e7596-df7a-4c27-a484-5e09e6ae00ee\" id=\"a81e7596-df7a-4c27-a484-5e09e6ae00ee-link\">12<\/a><\/sup><\/p>\n\n\n\n<p>Likewise, the Pennsylvania Superior Court recognized a parents\u2019 property right in their son\u2019s dead body after the decedent was mistakenly cremated before an autopsy could occur.<sup data-fn=\"42721b19-1776-462e-bae5-4346f7269fad\" class=\"fn\"><a href=\"#42721b19-1776-462e-bae5-4346f7269fad\" id=\"42721b19-1776-462e-bae5-4346f7269fad-link\">13<\/a><\/sup> The court rejected the coroner\u2019s claim for immunity, reasoning that if he had custody of the remains when the mistake occurred the statutory exception for property under governmental control could apply, concluding: \u201cthere can be no doubt that the next of kin have a property right in the remains of their son.\u201d<sup data-fn=\"93d3cdbd-af35-46ff-9ccb-2c14d7be2405\" class=\"fn\"><a href=\"#93d3cdbd-af35-46ff-9ccb-2c14d7be2405\" id=\"93d3cdbd-af35-46ff-9ccb-2c14d7be2405-link\">14<\/a><\/sup><\/p>\n\n\n\n<p>Returning to the hypothetical before us, perhaps the family of the decedent could oppose reinterment under this quasi-property right in Pennsylvania. However, this limited property right will lose against the plot owner\u2019s right to an exclusive burial in that plot and the cemetery company\u2019s statutory duty to reinter the body.<\/p>\n\n\n\n<p>All in all, Pennsylvania\u2019s laws surrounding reinterment prompts food for thought: should the cold hand of the black letter law have the power to prevail over a family\u2019s moral claim to leave their decedent undisturbed?<\/p>\n\n\n<ol class=\"wp-block-footnotes\"><li id=\"9bb04f99-f120-44ae-b153-c0cee0e0ceee\"><a href=\"https:\/\/www.habbaspilaw.com\/the-consequences-of-improper-burial-legal-and-moral-considerations\/#:~:text=Improper%20burial%20can%20be%20viewed,handling%20the%20deceased%20person's%20remains.\" data-type=\"link\" data-id=\"https:\/\/www.habbaspilaw.com\/the-consequences-of-improper-burial-legal-and-moral-considerations\/#:~:text=Improper%20burial%20can%20be%20viewed,handling%20the%20deceased%20person's%20remains.\">The Consequences Of Improper Burial: Legal and Moral Considerations<\/a>. It can disrupt the grieving process, hinder closure, and cause additional emotional pain and distress.
