Although scholars emphasize there is not a direct connection between this banning and the modern-day book bans in America, the underlying principle of the \u2018\u201cpower of books to change people\u2019s minds\u2019\u201d is as applicable today as it was in 1637.<sup data-fn=\"64104c7a-eaa9-4fe0-97e0-aa7a0410fa34\" class=\"fn\"><a href=\"#64104c7a-eaa9-4fe0-97e0-aa7a0410fa34\" id=\"64104c7a-eaa9-4fe0-97e0-aa7a0410fa34-link\">3<\/a><\/sup><\/p>\n\n\n\n<p>The president of the American Library Association, Emily Drabinski, explains the process of removing a book from a public or school library. After a \u201cchallenge\u201d is issued against a book alleging it is \u201charmful or dangerous,\u201d library officials begin the formal reconsideration process to determine if the book fits the \u201clibrary selection criteria.\u201d<sup data-fn=\"49fcdc93-5065-4e58-aae3-ee253b6817b4\" class=\"fn\"><a href=\"#49fcdc93-5065-4e58-aae3-ee253b6817b4\" id=\"49fcdc93-5065-4e58-aae3-ee253b6817b4-link\">4<\/a><\/sup> Both public and school library boards tend to restrict access to a challenged book immediately.<sup data-fn=\"daaad203-ea6a-4972-ba86-b42862cfe76c\" class=\"fn\"><a href=\"#daaad203-ea6a-4972-ba86-b42862cfe76c\" id=\"daaad203-ea6a-4972-ba86-b42862cfe76c-link\">5<\/a><\/sup> A book may be challenged, but the term \u201cbanned book\u201d is reserved for books pulled from shelves and removed from circulation.<sup data-fn=\"4fd8b518-27e0-417d-83e3-03579e27fe01\" class=\"fn\"><a href=\"#4fd8b518-27e0-417d-83e3-03579e27fe01\" id=\"4fd8b518-27e0-417d-83e3-03579e27fe01-link\">6<\/a><\/sup><\/p>\n\n\n\n<p>While some disfavor the term book ban, as an overly inflammatory and inaccurate description of the current efforts to remove books from public and school libraries<sup data-fn=\"b87b1ade-64cf-4dbd-a049-41744f13964f\" class=\"fn\"><a href=\"#b87b1ade-64cf-4dbd-a049-41744f13964f\" id=\"b87b1ade-64cf-4dbd-a049-41744f13964f-link\">7<\/a><\/sup>, there is no question that the stories targeted disproportionately represent those of the BIPOC and LGBTQIA+ communities.<sup data-fn=\"a18f089a-bb3a-418c-92b6-928ae1cb0ca1\" class=\"fn\"><a href=\"#a18f089a-bb3a-418c-92b6-928ae1cb0ca1\" id=\"a18f089a-bb3a-418c-92b6-928ae1cb0ca1-link\">8<\/a><\/sup> 47% of the 1,247 requests to remove library material were stories written by and about the lived experience of BIPOC and LGBTQIA+ individuals.<sup data-fn=\"01175058-518f-4528-b6cc-9a6383439f30\" class=\"fn\"><a href=\"#01175058-518f-4528-b6cc-9a6383439f30\" id=\"01175058-518f-4528-b6cc-9a6383439f30-link\">9<\/a><\/sup> Opponents of these books argue that topics of race, gender and sexuality are too mature for younger audiences, and therefore should not be available to them in any form. Books have also been banned for containing themes of sexuality, violence, drug use, and witchcraft.<sup data-fn=\"9789c74b-bdc4-4b0e-955d-34320b48c636\" class=\"fn\"><a href=\"#9789c74b-bdc4-4b0e-955d-34320b48c636\" id=\"9789c74b-bdc4-4b0e-955d-34320b48c636-link\">10<\/a><\/sup><\/p>\n\n\n\n<p>Book banning is deeply entangled with First Amendment rights. The process of challenging a book is an exercise of a person\u2019s First Amendment rights of free speech and petition. However, to actually ban a book can be a violation of First Amendment rights. While libraries are within their right to remove books that are \u201c\u2018pervasively vulgar or educationally unsuitable,\u2019\u201d the Supreme Court addressed the extent to which school libraries can ban books in <span style=\"text-decoration: underline;\">Board of Educ., Island Trees Union Free School Dist. No. 26 v. Pico<\/span>.<sup data-fn=\"905c4dfa-82a0-4a0c-9a45-696cecfb866e\" class=\"fn\"><a href=\"#905c4dfa-82a0-4a0c-9a45-696cecfb866e\" id=\"905c4dfa-82a0-4a0c-9a45-696cecfb866e-link\">11<\/a><\/sup><\/p>\n\n\n\n<p>More commonly referred to as <span style=\"text-decoration: underline;\">Pico<\/span>, the case arose out of a controversial book banning at public schools within the Island Trees School district.<sup data-fn=\"96ac904f-a12a-4265-a581-69e9044f1ea4\" class=\"fn\"><a href=\"#96ac904f-a12a-4265-a581-69e9044f1ea4\" id=\"96ac904f-a12a-4265-a581-69e9044f1ea4-link\">12<\/a><\/sup> Students from the junior and senior high schools sued after members of the school district\u2019s Board of Education gave an \u201cunofficial direction\u201d to the Superintendent and Principals of the schools to remove the listed books from the libraries for inspection by the Board.<sup data-fn=\"d93dd65c-67f7-4684-bbec-7bef7baeb542\" class=\"fn\"><a href=\"#d93dd65c-67f7-4684-bbec-7bef7baeb542\" id=\"d93dd65c-67f7-4684-bbec-7bef7baeb542-link\">13<\/a><\/sup> The books removed were described as \u201canti-American, anti-Christian, anti-Sem[i]tic, and just plain filthy.\u201d<sup data-fn=\"526906f7-4c4d-4005-ae3d-eb02838e63c8\" class=\"fn\"><a href=\"#526906f7-4c4d-4005-ae3d-eb02838e63c8\" id=\"526906f7-4c4d-4005-ae3d-eb02838e63c8-link\">14<\/a><\/sup> The books were reviewed by a committee or parents and board members who recommended two of the eleven books be removed from circulation. Ultimately, the board rejected the report and determined only one book could be returned to circulation and another could be made available upon parent approval. The remaining books were to be removed entirely from circulation in the school libraries.<sup data-fn=\"0bf91f7a-34de-4fa7-9fa7-8fd7c616b194\" class=\"fn\"><a href=\"#0bf91f7a-34de-4fa7-9fa7-8fd7c616b194\" id=\"0bf91f7a-34de-4fa7-9fa7-8fd7c616b194-link\">15<\/a><\/sup>\u00a0<\/p>\n\n\n\n<p>The Pico Court emphasized that the student\u2019s First Amendment right of\u00a0 access to information and ideas was violated when the books were removed from their school library.<sup data-fn=\"8aac6c15-898d-457e-98d3-2be0c6dfb7be\" class=\"fn\"><a href=\"#8aac6c15-898d-457e-98d3-2be0c6dfb7be\" id=\"8aac6c15-898d-457e-98d3-2be0c6dfb7be-link\">16<\/a><\/sup> However, the Court also determined that while schools do have \u201csignificant discretion,\u201d the discretion \u201cmay not be exercised in a narrowly partisan or political manner.\u201d<sup data-fn=\"80c063b4-a33c-4f53-a2d4-a345a2e6220d\" class=\"fn\"><a href=\"#80c063b4-a33c-4f53-a2d4-a345a2e6220d\" id=\"80c063b4-a33c-4f53-a2d4-a345a2e6220d-link\">17<\/a><\/sup>\u00a0 Although schools do have significant say in what is in their libraries, local school boards are not permitted to ban books \u201csimply because they dislike the ideas contained in those books.\u201d<sup data-fn=\"f8680c1d-04c4-41ed-8635-3548c6a780f2\" class=\"fn\"><a href=\"#f8680c1d-04c4-41ed-8635-3548c6a780f2\" id=\"f8680c1d-04c4-41ed-8635-3548c6a780f2-link\">18<\/a><\/sup><\/p>\n\n\n\n<p>Despite the significance of the <span style=\"text-decoration: underline;\">Pico<\/span> decision, book banning is still occurring at an alarmingly increasing rate.
