However, not all luxury brands, including Chanel, are in favor of second-hand marketplaces.<a href=\"#_ftn5\" id=\"_ftnref5\"><sup>[5]<\/sup><\/a><\/p>\n\n\n\n<p>Chanel first filed a complaint against WGACA back in 2018, alleging trademark infringement, unfair competition, false advertising, and the sale of counterfeit goods.<a href=\"#_ftn6\" id=\"_ftnref6\"><sup>[6]<\/sup><\/a> WGACA carries various brands, but claims to have \u201cthe world\u2019s largest collection of vintage Chanel.\u201d<a href=\"#_ftn7\" id=\"_ftnref7\"><sup>[7]<\/sup><\/a> However, Chanel argued that WGACA\u2019s practices, such as these claims, deceived consumers into believing that the retailer had a relationship with Chanel.<a href=\"#_ftn8\" id=\"_ftnref8\"><sup>[8]<\/sup><\/a> Besides selling unauthorized Chanel branded goods, WGACA also allegedly sold counterfeit items and used false advertising claims.<a href=\"#_ftn9\" id=\"_ftnref9\"><sup>[9]<\/sup><\/a><\/p>\n\n\n\n<p>Section 1114 of the Lanham Act imposes civil liability on those who reproduce, counterfeit, copy, or imitate registered trademarks to avoid confusion among consumers.<a href=\"#_ftn10\" id=\"_ftnref10\"><sup>[10]<\/sup><\/a> However, courts have used the \u201cPolaroid factors\u201d to determine whether a counterfeit trademark presents a likelihood of confusion for there to be infringement.<a href=\"#_ftn11\" id=\"_ftnref11\"><sup>[11]<\/sup><\/a> Those factors include: (1) strength of the mark; (2) proximity of goods; (3) similarity of marks; (4) any evidence of actual confusion; (5) marketing channels used; (6) type of goods and degree of care likely to be exercised by purchaser; (7) defendants\u2019 intent in selecting mark; and (8) likelihood of expansion of product lines.<a href=\"#_ftn12\" id=\"_ftnref12\"><sup>[12]<\/sup><\/a><\/p>\n\n\n\n<p>However, under 17 U.S.C. \u00a7 109, or the First Sale Doctrine, the purchaser of copywritten or trademarked material has the right to sell, display, or dispose of the material.<a href=\"#_ftn13\" id=\"_ftnref13\"><sup>[13]<\/sup><\/a> Under this doctrine, the owner of the copyright or trademark no longer has the right to control the future distribution or resale of the product.<a href=\"#_ftn14\" id=\"_ftnref14\"><sup>[14]<\/sup><\/a> This essentially allows resale marketplaces, such as WGACA, to operate legally.<\/p>\n\n\n\n<p>In this matter, Chanel argued that WGACA\u2019s use of Chanel\u2019s trademark, images of founder Coco Chanel, the hashtag \u201c#WGACACCHANEL,\u201d use of Chanel runway shows, and prior Chanel advertising created a false association with Chanel.<a href=\"#_ftn15\" id=\"_ftnref15\">[15]<\/a> In doing so, this led to the likelihood of confusion.<a href=\"#_ftn16\" id=\"_ftnref16\">[16]<\/a> Chanel\u2019s legal team and David Franklyn, expert witness in the matter and director of the McCarthy Institute for IP and Technology Law, conducted a survey and concluded that confusion among consumers existed.<a href=\"#_ftn17\" id=\"_ftnref17\">[17]<\/a> The survey found that 47% of surveyed consumers believed that Chanel was associated with WGACA and 73% believed that WGACA was either an affiliate, partner, collaborator, or authorized reseller of Chanel.<a href=\"#_ftn18\" id=\"_ftnref18\">[18]<\/a><\/p>\n\n\n\n<p>Trademark protection is essential for luxury brands such as Chanel to ensure their reputation among consumers. Not only has this case provided continued protection, but it has also set a precedent for issues regarding secondary markets for luxury goods.<a href=\"#_ftn19\" id=\"_ftnref19\"><sup>[19]<\/sup><\/a> In this case, the jury ultimately agreed with Chanel on all four counts and awarded statutory damages of $4 million.<a href=\"#_ftn20\" id=\"_ftnref20\"><sup>[20]<\/sup><\/a><\/p>\n\n\n\n<hr
