{"id":14277,"date":"2023-10-04T13:53:30","date_gmt":"2023-10-04T18:53:30","guid":{"rendered":"https:\/\/sites.law.duq.edu\/juris\/?p=14277"},"modified":"2023-10-04T13:54:59","modified_gmt":"2023-10-04T18:54:59","slug":"ncaa-continues-lobbying-congress-to-pass-bill-regulating-name-image-and-likeness","status":"publish","type":"post","link":"https:\/\/sites.law.duq.edu\/juris\/2023\/10\/04\/ncaa-continues-lobbying-congress-to-pass-bill-regulating-name-image-and-likeness\/","title":{"rendered":"NCAA Continues Lobbying Congress To Pass Bill Regulating Name, Image and Likeness"},"content":{"rendered":"\n<p>By Chris Mackey, Staff Writer<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><a href=\"https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2023\/10\/Picture1-1.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"332\" height=\"221\" src=\"https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2023\/10\/Picture1-1.jpg\" alt=\"\" class=\"wp-image-14278\" srcset=\"https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2023\/10\/Picture1-1.jpg 332w, https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2023\/10\/Picture1-1-300x200.jpg 300w\" sizes=\"auto, (max-width: 332px) 100vw, 332px\" \/><\/a><\/figure>\n<\/div>\n\n\n<p class=\"has-text-align-center\"><em>Photo Courtesy of Unsplash.com<\/em><\/p>\n\n\n\n<p>After visiting Capitol Hill nine times over a four-year span, a contingent of representatives from the National Collegiate Athletic Association (\u201cNCAA\u201d) are still awaiting the legislation for which they are lobbying.<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a><sup>&nbsp; <\/sup>On Wednesday, September 20<sup>th<\/sup>, 2023, NCAA representatives were back in D.C. hoping that Congress would use their legislative power to enact a federal bill governing the \u201cName, Image and Likeness\u201d (\u201cNIL\u201d) landscape.<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a>&nbsp;<\/p>\n\n\n\n<p>In 2021, the NCAA adopted an NIL policy, allowing college athletes the opportunity to be compensated.<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a>&nbsp; Following the landmark Supreme Court decision in <em>NCAA v. Alston<\/em>,<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a> the NCAA retracted their previous stance against allowing collegiate athletes to profit from their name, image, and likeness.<a href=\"#_ftn5\" id=\"_ftnref5\">[5]<\/a>&nbsp; The lack of uniformity has left institutions choosing between state law, NCAA guidelines and conference regulations to determine compliance.<a href=\"#_ftn6\" id=\"_ftnref6\">[6]<\/a>&nbsp;<\/p>\n\n\n\n<p>\u201cTrust me, I never wanted to come to the federal government to ask for help,\u201d stated Gene Smith as he spoke last week before the House Committee on Small Business.<a href=\"#_ftn7\" id=\"_ftnref7\">[7]<\/a><sup>. <\/sup>Smith is the Athletic Director at Ohio State University.&nbsp; As co-chair of the NCAA\u2019s NIL working group, Smith has been tasked with creating a plan of action for the NCAA to navigate the issue.<a href=\"#_ftn8\" id=\"_ftnref8\">[8]<\/a><sup>&nbsp; <\/sup>Smith\u2019s proposal is to build on the current scholarship model being utilized in college athletics by adding an amount of NIL money to the scholarship that is dispersed through the universities.<a href=\"#_ftn9\" id=\"_ftnref9\">[9]<\/a>&nbsp;&nbsp; Although he is uncertain about the details of the plan, Smith is also proposing licensing agreements between the universities and their respective athletes that would help facilitate NIL deals.<a href=\"#_ftn10\" id=\"_ftnref10\">[10]<\/a>&nbsp; Two key points in Smith\u2019s proposal are the mandating of any agents who represent athletes to be registered similar to professional sports, as well as the creation of a national NIL registry that would promote transparency in the marketplace.<a href=\"#_ftn11\" id=\"_ftnref11\">[11]<\/a>&nbsp; The current NIL landscape has led to alleged pay-for-play schemes.<a href=\"#_ftn12\" id=\"_ftnref12\">[12]<\/a>&nbsp; Smith noted during the hearing, \u201cA practice of asking a school for a fee to simply visit campus has emerged; asking for $5,000 just to visit has become common.\u201d<a href=\"#_ftn13\" id=\"_ftnref13\">[13]<\/a>&nbsp;The NCAA is also dealing with the fallout related to <em>Alston<\/em> and currently undergoing litigation that may force the NCAA to retroactively pay billions to former college athletes.<a href=\"#_ftn14\" id=\"_ftnref14\">[14]<\/a>&nbsp; One of the cases, <em>House v. NCAA<\/em>,<a href=\"#_ftn15\" id=\"_ftnref15\">[15]<\/a> underwent a class action certification hearing on September 21<sup>st<\/sup>, 2023.<a href=\"#_ftn16\" id=\"_ftnref16\">[16]<\/a>&nbsp;<\/p>\n\n\n\n<p>If a federal bill is to be passed by Congress regulating the NIL landscape, it seems collectives may have caught the ire of politicians necessary to push for legislation. Collectives are donor led organizations, that facilitate NIL deals for players at the university they are affiliated with.<a href=\"#_ftn17\" id=\"_ftnref17\">[17]<\/a>&nbsp;&nbsp; The ambiguity of how collectives operate became a focal point of the hearing, as they were referred to as \u201clargely fan clubs.\u201d<a href=\"#_ftn18\" id=\"_ftnref18\">[18]<\/a> Congresswoman Nydia Vel\u00e1zquez spent five minutes during the hearing inquiring about collectives and whether the way they function is in violation of Title IX.<a href=\"#_ftn19\" id=\"_ftnref19\">[19]<\/a><\/p>\n\n\n\n<p>Will a comprehensive federal bill enacting NIL legislation be passed soon?
