Investigators determined that the planes crashed due to a variety of reasons, including \u201ca lack of transparency on the part of Boeing\u2019s management.\u201d<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn2\"><sup>[2]<\/sup><\/a>&nbsp;Boeing downplayed the significance of its automated flight control system to regulators, airlines, and pilots which led to disastrous results. Boeing admitted to misleading regulators about the safety of the 737 MAX planes.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn3\"><sup>[3]<\/sup><\/a>&nbsp;However, part of that admittance included the DOJ entering into a deferred prosecution agreement (DPA) with Boeing.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn4\"><sup>[4]<\/sup><\/a><\/p>\n\n\n\n<p>Under the agreement, Boeing agreed to pay a criminal monetary amount of $2.5 billion.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn5\"><sup>[5]<\/sup><\/a>&nbsp;Part of the money went to the victims\u2019 families and affected airlines who purchased the plane.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn6\"><sup>[6]<\/sup><\/a>&nbsp;The DOJ found that the agreement addressed Boeing\u2019s wrongdoings and held the company accountable for its criminal conduct.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn7\"><sup>[7]<\/sup><\/a>&nbsp;The agreement also included implementing a variety of safety committees, as well as adopting new policies and procedures.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn8\"><sup>[8]<\/sup><\/a>&nbsp;If Boeing adheres to the agreement, the criminal charges will be dropped and the DOJ will not prosecute.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn9\"><sup>[9]<\/sup><\/a><\/p>\n\n\n\n<p>However, others, including the victims\u2019 families, do not feel the DPA adequately addressed Boeing\u2019s misdeeds.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn10\"><sup>[10]<\/sup><\/a>&nbsp;The families charge that they should have been involved in the discussion process as required under the Crime Victims\u2019 Rights Act (CVRA).<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn11\"><sup>[11]<\/sup><\/a>&nbsp;Moreover, the families argue that they were not provided with timely notice nor were they treated \u201cwith fairness\u201d under the CVRA.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn12\"><sup>[12]<\/sup><\/a><\/p>\n\n\n\n<p>In October 2022, the U.S. district court in northern district of Texas held that the families were \u201ccrime victims\u201d within the meaning of the CVRA.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn13\"><sup>[13]<\/sup><\/a>&nbsp;The court reserved remedies for a later date and in February 2023 ruled that the DPA was still in effect and would not reject the agreement.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn14\"><sup>[14]<\/sup><\/a>&nbsp;Ultimately, the court found that it did not have statutory authority to substantively supervise the DPA.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn15\"><sup>[15]<\/sup><\/a>&nbsp;The Speedy Trial Act allows the prosecution to enter into a deferral agreement with a defendant \u201cwith the approval of the court[.]\u201d<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn16\"><sup>[16]<\/sup><\/a>&nbsp;The victim\u2019s families contend that this approval includes reviewing the written agreement and approving or disapproving its written terms.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn17\"><sup>[17]<\/sup><\/a><\/p>\n\n\n\n<p>The court disagreed and found that this argument was not persuasive, especially in light of separation of power concerns for interfering in a congressionally authorized Executive\u2019s DPA.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn18\"><sup>[18]<\/sup><\/a>&nbsp;The court could not find authority granting it the power to withhold approval of the DPA because it disagreed with some of the agreement\u2019s substantive provisions.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn19\"><sup>[19]<\/sup><\/a>&nbsp;The court also did not find that it had any inherent authority because the government did not enter into the DPA in bad faith.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn20\"><sup>[20]<\/sup><\/a><\/p>\n\n\n\n<p>Therefore, although the court agrees that the government did violate the CVRA, there is no available remedy to withhold approval of the DPA because the court lacks the authority to do so and the government acted in good faith.<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn21\"><sup>[21]<\/sup><\/a>The court stated that \u201cCongress\u2014not the courts\u2014is the appropriate venue to redress the inadequacies of this statutory enactment.\u201d<a href=\"applewebdata:\/\/F31C39DD-2794-4C0A-981C-2F11A257FB22#_ftn22\"><sup>[22]<\/sup><\/a>&nbsp;The victim\u2019s families plan to appeal the
