{"id":13807,"date":"2022-05-23T21:45:58","date_gmt":"2022-05-24T02:45:58","guid":{"rendered":"http:\/\/sites.law.duq.edu\/juris\/?p=13807"},"modified":"2022-05-24T20:04:01","modified_gmt":"2022-05-25T01:04:01","slug":"exploring-the-new-autism-in-the-courts-taskforce","status":"publish","type":"post","link":"https:\/\/sites.law.duq.edu\/juris\/2022\/05\/23\/exploring-the-new-autism-in-the-courts-taskforce\/","title":{"rendered":"Exploring The New \u201cAutism in The Courts\u201d Taskforce"},"content":{"rendered":"\n<div class=\"wp-block-image is-style-default\"><figure class=\"aligncenter size-full\"><a href=\"http:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/05\/NietupskiFeature.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1014\" height=\"678\" src=\"http:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/05\/NietupskiFeature.jpg\" alt=\"\" class=\"wp-image-13808\" srcset=\"https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/05\/NietupskiFeature.jpg 1014w, https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/05\/NietupskiFeature-300x201.jpg 300w, https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/05\/NietupskiFeature-768x514.jpg 768w, https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/05\/NietupskiFeature-800x535.jpg 800w, https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/05\/NietupskiFeature-580x388.jpg 580w\" sizes=\"auto, (max-width: 1014px) 100vw, 1014px\" \/><\/a><figcaption><em>Photo courtesy of unsplash.com<\/em><\/figcaption><\/figure><\/div>\n\n\n\n<p class=\"has-text-align-center\">By Anabelle Nietupski, Web Editor<\/p>\n\n\n\n<p>The Pennsylvania Supreme Court is beginning to formally address the needs of individuals with autism spectrum disorder (ASD) and other intellectual disabilities through the advocacy of a taskforce aimed at increasing accessibility.<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn1\"><sup>[1]<\/sup><\/a>&nbsp;&nbsp;Specifically, issues stem&nbsp;\u201c[f]rom unnecessary confrontations with police to uninformed judges and needless incarceration\u201d leaving \u201cautistic people in Pennsylvania say[ing] the criminal justice system has long failed to meet their needs.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn2\"><sup>[2]<\/sup><\/a><\/p>\n\n\n\n<p>It has been noted that in many court systems, including the Pennsylvania Court System, there has been an inequity of resources and \u201cbias in the evaluation process makes diagnoses especially rare in low-income communities and communities of color,\u201d resulting in many individuals never being formally diagnosed with ASD.<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn3\"><sup>[3]<\/sup><\/a>&nbsp;Thus, \u201c[a]t present, there\u2019s no way to know how many autistic people are even in Pennsylvania jails, leaving them vulnerable at every level of the justice system. \u201c<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn4\"><sup>[4]<\/sup><\/a><\/p>\n\n\n\n<p>A press release dated February 1<sup>st<\/sup>&nbsp;2022 formally announced the trajectory of the \u201cAutism in the Courts\u201d taskforce, and their intention to improve accessibility for the \u201cone in 46 children and one in 59 Pennsylvanians\u201d that&nbsp;<em>have&nbsp;<\/em>been diagnosed with ASD.<sup>&nbsp;<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn5\"><sup>[5]<\/sup><\/a><\/sup>&nbsp;As of January 1<sup>st<\/sup>&nbsp;2019, the Commonwealth of Pennsylvania had 200,778 pending civil cases and 75,633 pending criminal cases, spanning throughout the counties, at various levels.<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn6\"><sup>[6]<\/sup><\/a>&nbsp;&nbsp;With such a large amount of people engaging with the Pennsylvania Court System daily, undoubtedly some of them with ASD and other intellectual disabilities, such a taskforce could make a significant difference in the accessibility of the justice system in Pennsylvania.&nbsp;<\/p>\n\n\n\n<p>A common concern regarding the implementation of advocacy on behalf of any marginalized group arises when those distanced from the marginalized group seek to advocate for them, separating the voices of those who are marginalized from the voices of the individuals acting. Individuals on the autism spectrum often experience difficulty with communication, making it even more important for leaders to listen.<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn7\"><sup>[7]<\/sup><\/a>\u00a0Looking to the philosophy, authority, and methodology of the taskforce, the question to consider is\u00a0<em>will their advocacy improve the way individuals with ASD and other intellectual disabilities engage with the Pennsylvania court system?\u00a0<\/em><\/p>\n\n\n\n<p>The taskforce answers this, as identified in the February 1<sup>st<\/sup>&nbsp;press release, as they express their intention to focus \u201con providing increased training opportunities for judges, helping further identify gaps in the system for individuals with autism and intellectual disabilities and creating a local roadmap to resources and services.\u201d&nbsp;<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn8\"><sup>[8]<\/sup><\/a>&nbsp;The taskforce began by addressing the parameters of their advocacy, determining \u201cwhether change should be incremental and start with the courts, specifically judges, or should be more immediate and do more to keep individuals out of the justice system. \u201c<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn9\"><sup>[9]<\/sup><\/a><\/p>\n\n\n\n<p>However, there are concerns about what the taskforce has done in their parameters. Seasoned advocates, like Cori Frazer, a licensed social worker and executive director of the Pittsburgh Center for Autistic Advocacy, often take issue with the typical framing of advocacy efforts aimed at those on the autism spectrum. Frazer noted, \u201c[t]he big problem \u2026 is that they\u2019re kind of framing it as an autism problem \u2026The court doesn\u2019t know autism. The problem that exists is the court has an ableism problem.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn10\"><sup>[10]<\/sup><\/a>\u00a0Frazier also stated that\u00a0common areas of miscommunication are of utmost importance for the taskforce, as \u201c[a]utism generally impacts an individual\u2019s social skills and ability to communicate, leading them to act and express themselves in unique ways.\u00a0This can escalate to autistic people being arrested, convicted, and incarcerated by a justice system ill-equipped to support them. A failure to understand their needs might mean they\u2019re punished for trying to comfort themselves in a traumatizing environment.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn11\"><sup>[11]<\/sup><\/a>\u00a0Without consistent diagnosis, advocates find difficulty even just locating individuals in need of intervention, especially once they enter the prison system. \u201cThat\u2019s the scariest part,\u201d Frazer said. \u201cI don\u2019t know what it\u2019s like inside because we lose people.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn12\"><sup>[12]<\/sup><\/a><\/p>\n\n\n\n<p>According to Allegheny County President Judge Kim Berkeley Clark, the taskforce has limited tangible reach until more people, from various parts of the Pennsylvania justice system, are brought into the conversation.<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn13\"><sup>[13]<\/sup><\/a>&nbsp;Clark stated, \u201cmore police representatives, judges and corrections officials need to be brought to the table before [the taskforce] can move on[to] bigger reforms, like creating designated housing for autistic individuals in the county jail.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn14\"><sup>[14]<\/sup><\/a>&nbsp;Yet, Clark also acknowledged her own potential reach, explaining that \u201c[i]n the meantime, she hopes to tackle \u201clow-hanging\u201d projects like reworking the jail intake forms and the ongoing addition of autism-friendly sensory spaces to county court buildings.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn15\"><sup>[15]<\/sup><\/a><\/p>\n\n\n\n<p>Six \u201cStatewide\/Regional Autism Roundtable\u201d events were held from November 2020 to June 2021 to gather information to focus the efforts of the taskforce.<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn16\"><sup>[16]<\/sup><\/a>\u00a0A lengthy list of qualified panelists were involved with the events, including: Nina Wall MSS, LSW, both the Director of the Bureau of Supports for Autism and Special Populations and a parent of an adult living with ASD, and Ardhika Aziz, a neuroscientist on the autism spectrum who specializes in autism research.<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn17\"><sup>[17]<\/sup><\/a>\u00a0State Supreme Court Justice Kevin Dougherty, a leader in this initiative, \u201cnoted that the panels, which saw over 12,000 attendees during their run, have helped create a network of officials across the state dedicated to enacting autism-focused reforms.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn18\"><sup>[18]<\/sup><\/a>\u00a0Dougherty felt the takeaways from the panel discussion were clear, continually hearing participants express \u201cthe need for reform beyond courtroom accommodations, [including] a database to identify autistic individuals in the justice system and alternative sentencing options.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn19\"><sup>[19]<\/sup><\/a><\/p>\n\n\n\n<p>The \u201cAutism in the Courts\u201d taskforce is not the only group concerned with the accessibility of the Pennsylvania court system for those on the autism spectrum. The Office of Developmental Programs (ODP), in collaboration with retired Judge William F. Ward of Allegheny County, empowered the ASERT Collaborative to create a \u201cJustice Process &amp; Intervention Opportunities Map.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn20\"><sup>[20]<\/sup><\/a>\u00a0This map illustrates how the criminal justice and court system should respond to situations involving individuals with intellectual disabilities.<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn21\"><sup>[21]<\/sup><\/a>\u00a0Important points of intervention are identified at different stages, including: community services\/pre-system entry; entry into the system; pre-trial services &amp; prosecution; preliminary procedures &amp; adjudication; sentencing\/sanctions; corrections; and re-integration\/re-entry.<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn22\"><sup>[22]<\/sup><\/a><\/p>\n\n\n\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0The Pennsylvania Supreme Court appears to have taken tremendous steps to include both experts, individuals diagnosed with ASD, and family members of those diagnosed with ASD and other intellectual disabilities in their pioneering of an \u201cAutism in the Courts\u201d taskforce \u201cfocused on issues affecting justice-involved individuals with autism and intellectual disabilities.\u201d<a href=\"applewebdata:\/\/94F70C9D-DA61-4942-97F8-95F8BB119924#_ftn23\"><sup>[23]<\/sup><\/a>\u00a0Hopefully, individuals with autism spectrum disorder will soon see improvements stemming from the work of the taskforce.
