{"id":13703,"date":"2022-04-01T09:19:41","date_gmt":"2022-04-01T14:19:41","guid":{"rendered":"http:\/\/sites.law.duq.edu\/juris\/?p=13703"},"modified":"2022-04-01T09:19:42","modified_gmt":"2022-04-01T14:19:42","slug":"texas-governor-categorizes-transgender-healthcare-as-child-abuse","status":"publish","type":"post","link":"https:\/\/sites.law.duq.edu\/juris\/2022\/04\/01\/texas-governor-categorizes-transgender-healthcare-as-child-abuse\/","title":{"rendered":"Texas\u2019 Governor Categorizes Transgender Healthcare as \u201cChild Abuse\u201d"},"content":{"rendered":"\n<p>By Antonia Gelorme, Staff Writer<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><a href=\"http:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/04\/Screen-Shot-2022-04-01-at-10.18.16-AM.png\"><img loading=\"lazy\" decoding=\"async\" width=\"478\" height=\"314\" src=\"http:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/04\/Screen-Shot-2022-04-01-at-10.18.16-AM.png\" alt=\"\" class=\"wp-image-13704\" srcset=\"https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/04\/Screen-Shot-2022-04-01-at-10.18.16-AM.png 478w, https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2022\/04\/Screen-Shot-2022-04-01-at-10.18.16-AM-300x197.png 300w\" sizes=\"auto, (max-width: 478px) 100vw, 478px\" \/><\/a><figcaption>Picture courtesy of unsplash.com<\/figcaption><\/figure>\n\n\n\n<p>A broadened reading of what constitutes \u201cchild abuse\u201d may serve as the new front in state governments\u2019 push to regulate transgender youth healthcare.&nbsp;<\/p>\n\n\n\n<p>On Feb. 18, 2022, Governor Greg Abbott directed the state\u2019s Department of Family and Protective Services (\u201cDFPS\u201d) to investigate the parents of a child who have consented to \u201cgender transitioning\u201d procedures on the charge of child abuse.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn1\"><sup>[1]<\/sup><\/a>&nbsp;The governor\u2019s direction came in the form of an opinion letter, alongside an opinion issued by the state\u2019s Attorney General, Ken Paxton.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn2\"><sup>[2]<\/sup><\/a><\/p>\n\n\n\n<p>In his opinion, the Attorney General indicated that the word \u201cabuse\u201d encompasses those actions taken by parents to provide their children with \u201csex change procedures.\u201d<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn3\"><sup>[3]<\/sup><\/a>&nbsp;The opinion includes both surgeries, like vaginoplasties and mastectomies, to the prescription of puberty-suppression drugs or hormone injections.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn4\"><sup>[4]<\/sup><\/a>The Attorney General noted these procedures, which vary in terms of invasiveness and reversibility, as especially concerning because they collectively endanger a child\u2019s fertility.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn5\"><sup>[5]<\/sup><\/a>&nbsp;This concern was derived, according to the opinion, from the \u201cunsettling\u201d phenomenon of sterilizing minors and other vulnerable populations without clear consent.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn6\"><sup>[6]<\/sup><\/a>&nbsp;Specifically, the Attorney General cited to the U.S. Supreme Court\u2019s finding in&nbsp;<em>Skinner v. Oklahoma<\/em>, where the Court determined that reproduction rights were protected under the Fourteenth Amendment from the compulsory sterilization criminal sentencing measures.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn7\"><sup>[7]<\/sup><\/a><\/p>\n\n\n\n<p>Here, though the opinion only addressed elective procedures performed as part of gender-affirming care, it suggested that even voluntary procedures imposed a danger to minor patients. Such procedures were further likened to procedures performed as a result of Munchausen by proxy, a form of medical abuse that has been recognized in the state prior to this opinion.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn8\"><sup>[8]<\/sup><\/a>&nbsp;In a \u201cMunchausen\u201d case, a parent may be held liable for child abuse where they \u201cseek[] to procure\u2014often by deceptive means, such as exaggeration\u2014unnecessary medical procedures or treatments\u201d for their children.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn9\"><sup>[9]<\/sup><\/a><\/p>\n\n\n\n<p>Ultimately, the opinion concluded that these \u201csex change procedures\u201d impose \u201cphysical injury that results in substantial harm to the child, or the genuine threat of substantial harm from physical injury to the child,\u201d or, in the alternative, \u201c\u2019mental or emotional injury to a child that results in an observable and material impairment in the child\u2019s growth, development, or psychological functioning\u2019 by subjecting a child to the mental and emotional injury associated with lifelong sterilization.\u201d<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn10\"><sup>[10]<\/sup><\/a><\/p>\n\n\n\n<p>Shortly after the opinion was released, the DFPS initiated investigations into families based solely on their providing gender-affirming care to transgender children, according to a petition filed by the American Civil Liberties Union (\u201cACLU\u201d).<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn11\"><sup>[11]<\/sup><\/a>&nbsp;These investigations prompted the ACLU to file its petition, particularly on behalf of an employee of DPFS who has a transgender child, her husband, the teen herself.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn12\"><sup>[12]<\/sup><\/a>&nbsp;The plaintiff mother and employee, who filed anonymously, was placed on leave at her position in the DFPS and subsequently investigated for child abuse on the basis of the teen\u2019s gender identity alone.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn13\"><sup>[13]<\/sup><\/a>&nbsp;Thus, the petition sought an immediate restraining order from the enforcement of the governor\u2019s opinion, as well as eventual injunction against enforcement and declaratory judgment that the DPFS adherence to the policy is illegal and unconstitutional as a matter of proper rulemaking.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn14\"><sup>[14]<\/sup><\/a><\/p>\n\n\n\n<p>In addition to the insecure footing of the governor\u2019s opinion, which cannot create any binding law, the ACLU also pointed to the fact that no other state in the country has categorized gender-affirming care as child abuse.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn15\"><sup>[15]<\/sup><\/a>&nbsp;Arkansas is the only state to implement a similar measure that criminalized the \u201cgender transitioning\u201d medical treatments, which was enacted in 2021 and shortly blocked thereafter.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn16\"><sup>[16]<\/sup><\/a><em>&nbsp;<\/em>In enjoining the state from enforcing the law, the United States District Court for the Eastern District of Arkansas determined that the law too narrowly targeted transgender youths and was only implemented to \u201cban an outcome that the State deems undesirable.\u201d<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn17\"><sup>[17]<\/sup><\/a><\/p>\n\n\n\n<p>On March 2, 2022, the District Court of Travis County, Texas granted the temporary restraining order against the enforcement of the policy against the plaintiffs in the case.<a href=\"applewebdata:\/\/49EBDE5D-5326-417E-9F65-F84210965941#_ftn18\"><sup>[18]<\/sup><\/a>&nbsp;Though the court will continue to hear arguments with regard to the broad state-wide injunction, those outside of the lawsuit may still be liable under the new policy.
