{"id":13479,"date":"2021-11-15T18:08:10","date_gmt":"2021-11-15T23:08:10","guid":{"rendered":"http:\/\/sites.law.duq.edu\/juris\/?p=13479"},"modified":"2021-11-15T18:18:02","modified_gmt":"2021-11-15T23:18:02","slug":"senate-subpoena-challenged-in-commonwealth-court","status":"publish","type":"post","link":"https:\/\/sites.law.duq.edu\/juris\/2021\/11\/15\/senate-subpoena-challenged-in-commonwealth-court\/","title":{"rendered":"Senate Subpoena Challenged in Commonwealth Court"},"content":{"rendered":"\n<p>By Jacob Schramm, Staff Writer<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><a href=\"http:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2021\/11\/Screen-Shot-2021-11-15-at-5.58.34-PM.png\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2021\/11\/Screen-Shot-2021-11-15-at-5.58.34-PM.png\" alt=\"\" class=\"wp-image-13494\" width=\"732\" height=\"692\" srcset=\"https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2021\/11\/Screen-Shot-2021-11-15-at-5.58.34-PM.png 732w, https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2021\/11\/Screen-Shot-2021-11-15-at-5.58.34-PM-300x284.png 300w, https:\/\/sites.law.duq.edu\/juris\/wp-content\/uploads\/2021\/11\/Screen-Shot-2021-11-15-at-5.58.34-PM-580x548.png 580w\" sizes=\"auto, (max-width: 732px) 100vw, 732px\" \/><\/a><figcaption>Photo courtesy of unsplash.com<\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>On September 15, the Pennsylvania Senate Intergovernmental Operations Committee (\u201cSIOC\u201d) issued a subpoena compelling the Department of State to provide voter records, including the \u201cnames, dates of birth, driver\u2019s license numbers (DLNs), last four digits of Social Security numbers (SSNs), addresses and methods of voting for participants, from the May primaries and November general election of 2020.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn1\"><sup>[1]<\/sup><\/a>&nbsp;The State Department refused to comply, and their challenges to the subpoena\u2019s enforceability are being heard in the Commonwealth Court.<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn2\"><sup>[2]<\/sup><\/a><\/p>\n\n\n\n<p>According to the legal brief for SIOC, prepared by Majority Leader Chris Dush and Pro Temp Jake Corman, the subpoena was issued as part of the Committee\u2019s investigation into \u201cthe need for potential remedial legislation related to Act 77 and Act 12.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn3\"><sup>[3]<\/sup><\/a>&nbsp;These laws were passed in October 2019 and expanded mail-in voting.<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn4\"><sup>[4]<\/sup><\/a>&nbsp;At a September 9 SIOC hearing preceding the subpoena, Dush stated the investigation \u201cis not about overturning the results of any election,\u201d but because \u201cthe legislature did not fully see the impacts of\u2026Act 77 and what they would do to our electoral system.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn5\"><sup>[5]<\/sup><\/a>Dush argues that the personal information sought by the subpoena would \u201creveal exactly how people voted in response to the options created by those laws, what problems they encountered, and whether the laws permitted unlawful double voting.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn6\"><sup>[6]<\/sup><\/a><\/p>\n\n\n\n<p>It has been settled on both sides that legislative committees may issue subpoenas and compel testimony for a legislative purpose.<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn7\"><sup>[7]<\/sup><\/a>&nbsp;The PA Constitution provides that the legislative branch shall make its own rules and procedures, and Senate Rule 14(d)(3) provides that each standing committee may compel production of any \u201cevidence desired by the committee.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn8\"><sup>[8]<\/sup><\/a>&nbsp;SIOC\u2019s brief cites to several PA cases that have called the legislative investigation tool \u201cbasic and fundamental\u201d and \u201ca power which should be liberally construed and sustained in safeguarding and preservation of a Republican form of government.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn9\"><sup>[9]<\/sup><\/a><\/p>\n\n\n\n<p>Three separate complaints were filed in the Commonwealth Court in response to the subpoena. Recently, the Court approved the intervention of public interest groups like Common Cause and the League of Women Voters.<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn10\"><sup>[10]<\/sup><\/a>&nbsp;While acknowledging the legal right of committees to issue subpoenas, these complaints establish that \u201cCourts protect against legislative compulsion to disclose information where the investigation will not further a legitimate legislative purpose.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn11\"><sup>[11]<\/sup><\/a>&nbsp;To that end, they argue that SIOC is continuing \u201ca prolonged, bad faith campaign to stoke distrust in Pennsylvania\u2019s election administration.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn12\"><sup>[12]<\/sup><\/a>&nbsp;They argue that Dush has a \u201clong history\u201d of parroting President Trump\u2019s \u201cbaseless allegations of widespread voter fraud,\u201d and \u201chas spent nearly a year promoting baseless conspiracy theories and allegations of widespread fraud.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn13\"><sup>[13]<\/sup><\/a><\/p>\n\n\n\n<p>The complaints point to several procedural safeguards implemented to verify election results, including a state-wide risk-limiting audit conducted after the 2020 General Election which found \u201cstrong evidence of the accuracy of the count of votes.\u201d<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn14\"><sup>[14]<\/sup><\/a>&nbsp;They also highlight the three separate legislative investigations into Pennsylvania\u2019s voting practices which have taken place between January and June 2021, resulting in a thorough assessment of current best-practices and recommendations for updating PA voting procedures.<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn15\"><sup>[15]<\/sup><\/a><\/p>\n\n\n\n<p>The complaints also suggest that any legislative purpose would be outweighed by the privacy concerns and potential impact on voters. The complaints cite both the US and PA Constitutional right to privacy, especially against the compulsion of the DLNs and SSNs.<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn16\"><sup>[16]<\/sup><\/a>&nbsp;Most of the sought information is public and can be accessed readily by anyone, including a PA Senate Committee, but the Commonwealth argues that PA law prohibits disclosure of DLNs and SSNs and find SIOC\u2019s argument unconvincing that those pieces of data are necessary to take legislative action.<a href=\"applewebdata:\/\/DA7D7644-19CE-41B2-B6C2-5FB10E9D529A#_ftn17\"><sup>[17]<\/sup><\/a>&nbsp;Additionally, the complaints articulate concern that SIOC will disclose that information to third parties.
