On February 5, 2019, San Diego City Council\u00a0members voted unanimously to repeal a 35-year-old law stating that it is illegal for people to live in their vehicles.[1]<\/sup><\/a> Councilman Mark Kerseysays the law, first passed in 1983, has outlived its usefulness; \u201cI think it\u2019s pretty clear today it\u2019s not the direction any of us are looking to go.\u201d[2]<\/sup><\/a><\/p>\n

The City of San Diego has struggled enforcing laws surrounding homelessness for years now.[3]<\/sup><\/a> In the past, the homeless seeking shelter in vehicles have been ticketed, fined, and if unable to pay, have had their cars impounded. \u201cIn the midst of a severe housing crisis characterized by dramatically rising rents, a shrinking affordable housing supply, long waits for housing subsidies, scarcity of shelter beds, and a homeless population that has grown 23% in five years, the City of San Diego is targeting its most vulnerable residents.\u201d[4]<\/sup><\/a> Advocates reason that punishing these people for seeking protection and shelter is not the answer. Many of the people living in their vehicles include families, the elderly,\u00a0and college students who might lack the funds to live elsewhere, stated Tristia Bauman, senior attorney for the\u00a0National Law Center on Homelessness &\u00a0Poverty.[5]<\/sup><\/a> Some families choose to live in a\u00a0recreational vehicle\u00a0in order to stay together because most emergency shelters allow only single adults. Shelters may also not be accessible to people with disabilities, explained attorney\u00a0Ann Menasche of Disability Rights California.[6]<\/sup><\/a><\/p>\n

California is not the only state that deals with questionable laws and harsh decisions; it is a nationwide concern. In 2005, the New York City Police Department attempted to deter serious crimes by cracking down on more minor ones such as unlicensed street peddling and fare-beating on buses.[7]<\/sup><\/a> Undercover police officers rode the bus at night to arrest those skirting the $2 fare.[8]<\/sup><\/a> Many of the arrested bus riders were on their way to homeless shelters. Kathryn Freed, one of five criminal court judges who questioned the wisdom of the arrests, said they interfered with the services the homeless persons were seeking, stating:<\/p>\n

I consistently put on the record how outraged I am by the whole thing. It\u2019s a complete waste of the court\u2019s time [to prosecute the illegal bus riders]. It takes a lot of person-power to process them, house them, and feed them. Meanwhile, the shelter, where they\u2019re heading, is set up to do just that.\u201d[9]<\/sup><\/a><\/p>\n

One of the men arrested on a bus, put it simply when he told the police \u201cYou\u2019re setting me up. They\u2019re the easiest victims, the homeless… Why don\u2019t you [the police] go fight some real crime?\u201d[10]<\/sup><\/a><\/p>\n

The case that drove this repeal began in 2015 when a couple living in an RV\u00a0came to Disabilities Rights California. As attorneys worked their case, they realized it was a much larger problem than it first appeared. The attorneys soon connected with other people hurt by the vehicle residency ordinances, and started to take action.[11]<\/sup><\/a> The repeal comes six months after a federal judge ordered the city to stop ticketing people under the law, saying it was unconstitutional because it\u2019s too vague for enforcement.[12]<\/sup><\/a> Councilman Kersey says, \u201cIt\u2019s certainly not a permanent solution to the crisis that we are facing, but 100 percent of the time, I\u2019d rather have someone sleeping in a car than on the sidewalk.\u201d[13]<\/sup><\/a> This repeal will help at least eight hundred San Diegans currently living in their vehicles, Menasche said. While the city still needs to update other laws, it is a step in the right direction.<\/p>\n
