Wright<\/p>\n<p>On December 06, 2022, before a Missouri federal judge, the popular clothing brand H&amp;M Hennes and Mauritz LP (known widely as \u201cH&amp;M\u201d) filed a motion to dismiss in response to a class action claim brought against their \u201cConscious Choice\u201d collection.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> This collection was marketed as being made from materials that are deemed to be more sustainable than comparative pieces of clothing from the store not included in the collection.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p>In early November of 2022, Abraham Lizama and Marc Doten (\u201cPlaintiffs\u201d) filed a complaint, alleging that H&amp;M\u2019s clothing collection is not sustainable, but rather made from materials harmful to the environment, and therefore H&amp;M\u2019s advertising of sustainability was deceptive.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> They claim that the recycled polyester utilized in the garments is chiefly sourced from recycled plastic bottles.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> However, once plastic bottles are converted into clothing articles, it is a \u201cone-way ticket to landfill, incineration or being dumped in nature\u201d, as the suit suggests.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> Plaintiffs accuse H&amp;M of using this collection as a way to \u2018greenwash\u2019 customers.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> \u2018Greenwashing\u2019 is a term used to describe deceiving efforts by a brand to make their goods seem more sustainable in order to appeal to the environmentally conscious consumer.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<p>H&amp;M believes these claims to be unfounded, qualifying them to be \u201cunreasonable leaps in logic.\u201d<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> The complaint should be dismissed, the company opined, because, inter alia, it selectively disregards the \u201csubstance and context of their candid disclosures.\u201d<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> Also asserted in its motion to dismiss are the claims that the class actions rests on attempts to \u201cfabricate and impute\u201d lies on the brand.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> \u201cH&amp;M is a pioneer of sustainability efforts in the fashion industry,\u201d defendants stated, highlighting their multiple acknowledgments from independent organizations throughout decades for their leadership in such efforts.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p>\u201cH&amp;M does not represent that its products are sustainable- full stop\u201d, the brand specified, \u201c[i]t does not even state that its clothes are \u2018more sustainable\u2019 than competitors.\u201d<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> The brand defends that its \u201cConscious Choice\u201d collection merely claimed, and disclosed via hangtags and the publicly available Material Categorization Report, that the clothing was made of more sustainable materials (recycled polyester) than those made with regularly used materials (virgin polyester).<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a> Recycled polyester leads to less water, fossil fuel, and carbon dioxide use.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/p>\n<p>It is the brand\u2019s view that this marketing would lead no reasonable consumer to interpret the collection to be \u201cinherently sustainable\u201d, adding that they \u201ccarefully qualified\u201d its use of the term \u201csustainable.\u201d<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a> In support of their argument, they cite to precedent that requires that when a court can determine as a matter of law that the public is not likely to be misled by the product, dismissal is appropriate.<a href=\"#_ftn16\" name=\"_ftnref16\">[16]<\/a><\/p>\n<p>In regards to Missouri\u2019s Merchandising Practices Act<a href=\"#_ftn17\" name=\"_ftnref17\">[17]<\/a>, H&amp;M asserts that the plaintiffs have suffered no ascertainable loss, nor have consumers of the collection.<a href=\"#_ftn18\" name=\"_ftnref18\">[18]<\/a> \u201cPlaintiffs received precisely what they bargained for\u201d, the brand asserted, citing that the items both by the plaintiffs contained at least 50% or more sustainable materials.<a href=\"#_ftn19\" name=\"_ftnref19\">[19]<\/a><\/p>\n<p>The implications of this case are important, especially to environmentally aware consumers. While H&amp;M contends that their Conscious Choice collection\u2019s marketing was not intentionally deceptive, the attempt to appear more outwardly sustainable, and thus drive sales, is clear. However, this is not the first time a company has stretched the benefits of a product to gain more appeal among their potential clients. For example, all too often we consume advertisements clad with photoshopped models, but buying that particular item won\u2019t make us look just like them. A consumer must always be vigilant when shopping for products, aware that businesses need to make sales to make a profit, and they will do so at the expense of their consumer\u2019s desire to have the unbent truth.<\/p>\n<p>H&amp;M appears to be no different. Their marketing pushed the narrative that their new collection was sustainable, and consumers purchased it with the benefit of the environment in mind. However, as H&amp;M stated, the sustainability claim was explained in plain text at the eye level of consumers. It has become the consumer\u2019s job to conduct proper research prior to buying, especially when looking to buy products that are classified as sustainable. While brands should be more upfront with potential buyers, it is the potential buyer\u2019s choice what they wish to consume. H&amp;M provided the information, but it was the buyer\u2019s job to seek it out.
